Payment Conditions

1. Original Artwork & Prices

All artworks offered by Svenja Herz are original, one-of-a-kind paintings, individually created by hand.

The price of an original artwork is determined by its canvas size:

The prices stated above are exclusive of shipping and packaging costs, incl. VAT. For original artworks painted by the artist and supplied in Germany, the applicable VAT rate is currently 7%. 

The final price, including VAT and any applicable shipping and packaging costs, will be told before sale and stated on the invoice.

International Shipping

For artworks shipped outside Germany, including shipments within the EU and to non-EU countries, additional customs, import duties, taxes and/or registration requirements may apply depending on the destination country.

Any such requirements and associated costs may vary depending on the destination and the value of the artwork and may therefore affect the final purchase and shipping price.

Where applicable, these costs will be assessed and communicated individually before shipping.

2. Commissions

If you would like to commission a painting, the final price is calculated individually.

The price depends on:

- the size of the canvas,

- the complexity of the requested artwork,

- the materials required, and

- the actual time and effort involved in creating the painting.

A final price will be agreed upon before the commission is started.

3. Payment

Payment is required before the artwork is shipped.

You can pay by:

- bank transfer based on the invoice, or

- PayPal.

Once full payment has been received, the artwork will be prepared for shipment.

The artwork will not be shipped until payment has been received in full.

4. Shipping & Packaging

Shipping and packaging costs are not included in the artwork price.

The exact shipping costs depend on the size, weight and destination of the artwork and will be communicated before shipping.

Every artwork is carefully and securely packaged to protect it during transport. Paintings are packed with appropriate protective materials and with additional protection against impact.

Once the artwork has been handed over to the shipping service provider, the shipping company's terms and conditions also apply.

5. Transport Damage

Although every artwork is carefully and impact-resistantly packaged, damage during transport can unfortunately never be completely ruled out.

Please inspect the package carefully upon delivery.

If the outer packaging shows any signs of damage, please:

1. Do not open the package immediately.

2. Take clear photographs of the still unopened package, including all visible damage.

3. Report the damage to the shipping service provider as soon as possible.

4. Keep all packaging materials until the matter has been resolved.

5. Please contact me immediately and send me the photographs and details of the damage.

The photographs of the unopened package are important documentation for a potential transport damage claim.

6. Returns & Right of Withdrawal

For purchases made online or otherwise as distance contracts with consumers, statutory consumer rights, including any applicable statutory right of withdrawal, remain unaffected.

Where a statutory right of withdrawal applies, the applicable withdrawal period is generally 14 days from receipt of the artwork.

To exercise a right of withdrawal, please contact me by email with a clear statement that you wish to withdraw from the purchase.

The artwork must then be returned in accordance with the applicable statutory requirements. Further information on the applicable return procedure and costs will be provided where required.

Custom-made commissioned artworks:

The statutory right of withdrawal may not apply to artworks that are not prefabricated and that are individually made according to the customer's specifications or are clearly personalised to the customer's needs.

Statutory warranty and consumer protection rights remain unaffected.

7. Ownership

Ownership of the artwork passes to the buyer once the full purchase price has been received and, where applicable, the artwork has been handed over or shipped.

Until full payment has been received, the artwork remains the property of Svenja Herz.

8. Copyright

The purchase of an original artwork transfers ownership of the physical artwork only.

Copyright and all associated intellectual property rights remain with Svenja Herz.

The buyer does not acquire the right to reproduce, commercially reproduce, distribute or otherwise exploit the artwork without prior written permission from the artist.

The artist reserves the right to photograph and reproduce images of sold artworks for portfolio, website, exhibition and promotional purposes, unless otherwise agreed in writing.
